As used in this contract the words, "you", "your", "buyer", "co-buyer", and "member" refer to each and all of those who sign this contract and if the context otherwise requires. The the person(s) for whom this contract is being purchased. The words "we", "our", "us", and "the center" refers to Marion Fitness 24/7, LLC, which is the seller of this contact, and if our rights under this contract are assigned to some other institution as the context requires.

IF WITHIN THREE (3) BUSINESS DAYS YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER OF THIS HEALTH CENTER, YOU MAY CANCEL THIS AGREEMENT BY MAILING A NOTICE TO THE HEALTH SPA BY MIDNIGHT OF THE THIRD BUSINESS DAY FOLLOWING YOUR PURCHASE OF THE CONTRACT STATING YOUR DESIRE TO CANCEL THIS CONTRACT. THE WRITTEN NOTICE SHOULD BE MAILED TO THE ABOVE ADDRESS.

You may also cancel this contract if any of the following occur:
a) You may cancel if, because of death or medical disability, you become unable to use a substantial portion of the centers facilities or services for thirty (30) or more days. In the event of medical disability, you must provide the center with a doctor's statement. In addition, the center may require to submit to a physical examination by mutually agreeable medial doctor, at its cost. Your estate may cancel in the event of your death.
b) You may cancel if the center relocates more than (5) miles from the location stated in the contract.
c) You may cancel if you relocate more than twenty-five (25) miles from your residence as stated in the contract, and the center cannot provide comparable facilities and services within five miles.

IN ORDER TO EXERCISE THESE ADDITIONAL CANCELLATION RIGHTS, YOU MUST NOTIFY THE CENTER IN WRITING, BY CERTIFIED MAIL, RETURN RECEIPT REQUESTED, OR BY PERSONAL DELIVERY, TO THE ADDRESS STATED ABOVE. ALL MONIEYS TO BE REFUNDED SHALL BE PAID TO YOU WITHIN THIRTY (30) DAYS AFTER THE CENTERS RECEIPT OF THE CANCELLATION NOTICE.

I accept full responsibility for my use of any and all equipment, appliances, facility privileges or services whatsoever owned and operated by Marion Fitness 24/7, LLC at my own risk and shall not hold this center, its owners, directors and/or employees harmless from any and all loss, claim, injury, damange, or liability substained or incurred by me resulting there from. We recommend that you consult a physician before starting an exercise program. Failure to abide by posted fitness center rules is cause for dismissal.
ANYONE UNDER 18 MUST HAVE A PARENT'S CONSENT, INCLUDING SIGNATURE. ANYONE 12 - 15 YEARS OLD MUST BE DIRECTLY SUPERVISED BY A PARENT/GUARDIAN. ANYONE UNDER 12 MAY NOT USE ANY OF THE EQUIPMENT AND/OR FREE WEIGHTS

NOTICE TO BUYER: DO NOT SIGN THIS CONTRACT UNTIL YOU HAVE READ ALL OF IT. ALSO DO NOT SIGN THIS CONTRACT IF IT CONTAINS ANY BLANK SPACES.
Buyer is entitled to a fully completed copy of this agreement at the time of signing.
